They had no official agreement or paperwork in place to say where they could use the video. The creator uploaded the video to a free clip site. The other party did not want the video on free sites as the co-star wanted anonymity. The other model and the photographer were also concerned about it being free. The solution here is clear, maintain your relationship, take down the video. In future make sure you have an explicit agreement as to where you are placing your content.

Another situation is Music. If you have a radio on in the back ground you may receive a take down request. Using your favorite song may also lead to a strike. Finally you may actually have the right to use, but failed to display the license.

Giving Credit for music

You can get music either by buying a license or using free music with a creative commons license. No matter how you get your music always make sure you have a tile in your video that shows your right to use.
It should look like this:

 

  • Music License: LICENCE TYPE (e.g. Attribution 3.0 Unported (CC BY 3.0)
  • Track: SONG NAME
  • Artist: PERFORMERS NAME
  • URL: The address the clip came from

Failure to display a copyright notice can lead to you receiving a takedown request even if you actually have the right to use the sound.
